1. Service provider identification and purpose

These Booking and Service Terms and Conditions govern the request, booking and provision of the experiences offered under the Ride Experience Barcelona brand through the rideexperiencebarcelona.com website and the communication channels made available for managing bookings.

Booking any of the experiences implies acceptance of these Terms and Conditions, which will be available for consultation before payment is made and the booking is confirmed.

The specific characteristics of each Ride —route, approximate duration, price and included services— will be those indicated on the corresponding page or booking proposal.

2. Service characteristics

Ride Experience Barcelona offers private experiences as a passenger on Harley-Davidson motorcycles ridden by riders, following pre-designed routes through Barcelona and other destinations.

The customer participates in the experience exclusively as a passenger and does not ride or operate the motorcycle.

Each motorcycle will carry one passenger in addition to its rider. When a booking includes several people, each passenger will travel on a motorcycle with their corresponding rider and, insofar as traffic conditions allow, all will follow the same route.

Rides are private: customers who are not part of the same booking will not be combined into the same experience.

2.1. What the Ride includes

Unless expressly stated otherwise in the corresponding description or proposal, the experience includes:

  • Harley-Davidson motorcycle and rider;
  • fuel required to complete the booked route;
  • approved motorcycle helmet for the passenger;
  • pre-Ride safety briefing;
  • playlist selected from the available options;
  • planned stops during the route;
  • photographs taken by the rider during stops;
  • digital destination guide, for those Rides where this is included.

2.2. What is not included

Unless expressly stated otherwise, the following are not included:

  • food and drinks;
  • admission to establishments, attractions or third-party activities;
  • purchases or personal expenses;
  • transport to or from the starting or finishing point of the Ride;
  • tourist services or activities contracted directly by the customer with third parties;
  • any additional service not expressly stated as included in the booked Ride.

Published duration, distance and route information is provided for reference and may be subject to reasonable adjustments due to traffic, roadworks, restrictions, weather, safety or other circumstances affecting the normal operation of the experience, in accordance with these Terms and Conditions.

3. Booking request, reservation and contracting

3.1. Booking request

The customer may submit a booking request using the form available on the website or via WhatsApp.

At a minimum, the customer must provide the Ride they wish to book, their preferred date and time, the number of passengers and the information necessary to process the request.

Submitting a request does not constitute confirmation of the booking.

Ride Experience Barcelona will check the availability of motorcycles and riders for the requested date and time.

3.2. Availability confirmation

If the request can be accommodated, Ride Experience Barcelona will confirm availability and provide the customer with the information necessary to complete the booking process and the Terms and Conditions applicable to the booking. The customer must accept these Terms and Conditions before receiving the secure payment link.

This confirmation means that we can provide the requested Ride under the conditions communicated, but does not yet constitute a confirmed booking.

3.3. Payment deadline and booking confirmation

Once availability has been confirmed, the customer will generally have 60 minutes from the time the payment link is sent to complete payment.

During this period, Ride Experience Barcelona will provisionally hold the offered availability.

If payment has not been completed within this period, Ride Experience Barcelona may release the requested date and time. Availability will then need to be checked again if the customer wishes to proceed with the booking.

The booking will be confirmed once payment has been completed.

Exceptionally, and only when previously agreed with Ride Experience Barcelona, payment may be authorised immediately before the experience begins.

3.4. Confirmation

Once the Ride has been confirmed, the customer will receive the information necessary to prepare for the experience, which may include:

  • confirmed Ride, date and time;
  • meeting point and location;
  • recommended arrival time;
  • clothing and footwear recommendations;
  • playlist selection;
  • basic instructions for the day of the experience;
  • digital destination guide, where applicable;
  • operational contact channel via WhatsApp.

Any modifications or customisations expressly agreed upon will also form part of the specific conditions applicable to that booking.

3.5. Information on electronic contracting

Before making payment, the customer will have access to these Terms and Conditions in a format that allows them to be consulted, stored and reproduced.

Ride Experience Barcelona will retain a record of the booking and the version of the Terms and Conditions accepted by the customer. The customer may subsequently request a copy of the Terms and Conditions applicable to their booking.

Before making payment, the customer may report any errors identified in the booking details or conditions so that they can be corrected.

The booking may be formalised in Spanish or English, depending on the language used during the booking process.

Once payment has been completed, Ride Experience Barcelona will confirm the booking electronically in a format that can be retained by the customer.

4. Prices and payment methods

The prices applicable to each Ride will be those indicated on the website or, in the case of a customised experience, those expressly communicated to the customer before the booking is confirmed.

The final price and included services will be communicated to the customer before payment is made.

Published prices are expressed in euros (€) and include all legally applicable taxes unless expressly stated otherwise.

4.1. Payment methods

Payment will be made using the methods made available by Ride Experience Barcelona at the time of booking.

When payment is made online, the customer will receive a link to a secure external payment platform, where they may use the payment methods available on that platform.

Ride Experience Barcelona does not receive or store the full details of bank cards used through such platforms.

Available payment methods may vary and will be displayed to the customer before completing the transaction.

4.2. Payment confirmation

The booking will be confirmed once payment has been completed, in accordance with the procedure and deadline established in Section 3 of these Terms and Conditions.

Once the Ride has been confirmed, the customer will receive the corresponding confirmation and the information necessary to prepare for the experience.

5. Participation conditions and requirements

To participate in a Ride, the passenger must meet the conditions necessary to travel safely as a passenger on a motorcycle.

Ride Experience Barcelona may check before departure that these conditions are met and will provide a mandatory safety briefing, which all participants must follow and respect.

5.1. Physical and functional conditions

The passenger must be able to:

  • get on and off the motorcycle safely, with reasonable assistance from the rider where necessary;
  • remain properly seated while the motorcycle is moving;
  • place their feet securely on the footrests;
  • hold on and maintain an appropriate position;
  • understand and follow the basic safety instructions provided by the rider.

No general minimum height is established. The possibility of participating will be assessed according to the conditions above.

The motorcycle is also subject to maximum load limits. For safety reasons and to maintain an appropriate margin within those limits, Ride Experience Barcelona establishes a maximum passenger weight of 100 kg. Compliance with this limit does not replace the other physical and functional requirements established in this section.

5.2. Circumstances that may affect safety

Before starting the Ride, the customer must disclose any circumstance that could significantly affect their ability to travel safely as a passenger.

There is no need to provide diagnoses, medical records or other detailed health information, but only the functional information necessary to assess safe participation.

Where there are reasonable doubts as to whether the experience can be carried out safely, Ride Experience Barcelona may decide not to start or to interrupt the Ride.

The financial consequences applicable in each case will be those established in the relevant sections of these Terms and Conditions.

5.3. Alcohol, drugs and other substances

No person may participate while under the influence of alcohol, drugs or other substances that may impair their ability to travel safely.

This condition applies both at the start of and throughout the experience.

If the rider reasonably considers that a passenger is in a condition incompatible with safety, the rider may prevent the Ride from starting or continuing.

Where this situation is attributable to the passenger, no refund will be due.

5.4. Right not to start or to interrupt the experience for safety reasons

Ride Experience Barcelona reserves the right not to start or to interrupt an experience when it reasonably considers that circumstances exist that could compromise the safety of the passenger, rider, other participants or third parties.

Any such decision must be based on safety considerations and applied reasonably and proportionately.

Where the cause results from the customer’s failure to comply with participation requirements or safety instructions, or from deliberately inappropriate conduct incompatible with the activity, no refund will be due.

Where, before starting the Ride, it is established that a passenger acting in good faith does not meet one of the functional conditions necessary to participate safely and the experience therefore cannot take place, Ride Experience Barcelona will refund 80% of the amount paid, retaining the remaining 20% to cover the costs and resources associated with a booking that had already been prepared and reserved for the customer.

This rule will not apply where the inability to participate results from false information or deliberate concealment, consumption of alcohol or other substances, failure to comply with previously communicated conditions or any other conduct attributable to the passenger that is incompatible with safety. In such cases, no refund may be due.

6. Minors

Ride Experience Barcelona is generally intended for persons aged 18 or over.

Exceptionally, minors aged 12 or over may be accepted, subject to prior assessment by Ride Experience Barcelona and the express authorisation of their parent or legal guardian.

6.1. Ages 12 to 15

Passengers aged 12 to 15 may participate exceptionally where:

  • Ride Experience Barcelona has previously approved their participation;
  • express authorisation has been provided by their parent or legal guardian;
  • the parent or legal guardian also participates in the same Ride;
  • and the minor meets all conditions necessary to travel safely as a passenger.

6.2. Ages 16 to 17

Passengers aged 16 and 17 may participate exceptionally, subject to prior approval and the express authorisation of their parent or legal guardian.

In these cases, the parent or legal guardian is not required to participate in the experience.

6.3. Children under 12

Children under 12 will not be permitted to participate.

6.4. Safety conditions

Authorisation from a parent or legal guardian does not in itself guarantee that the minor will be able to participate.

In all cases, without exception, the minor must be able to sit correctly and place their feet securely on the footrests, as well as meet all other participation and safety requirements.

Ride Experience Barcelona may refuse participation when it considers that these conditions are not adequately met.

Authorisation to participate in the Ride does not constitute authorisation for identifiable photographs or images of the minor to be used for commercial or promotional purposes. Any such consent must be requested specifically and separately.

7. Preparation, equipment and personal belongings

To enjoy the experience comfortably and safely, the passenger must follow the instructions provided by Ride Experience Barcelona before departure.

7.1. Clothing and footwear

No specific motorcycle equipment is required.

The passenger must wear clothing that adequately covers the body and closed footwear that is securely fastened to the foot.

Ride Experience Barcelona particularly recommends:

  • long trousers;
  • long-sleeved clothing;
  • closed and sturdy footwear;
  • clothing suitable for the expected weather conditions.

Ride Experience Barcelona may prevent the experience from starting when the passenger’s clothing or footwear represents an evident safety risk.

7.2. Helmet

Ride Experience Barcelona will provide the passenger with an approved motorcycle helmet, included in the price of the Ride.

The appropriate size and fit will be checked before departure.

Passengers may use their own helmet provided that it is approved, in good condition and suitable for the experience.

7.3. Motorcycle configuration

The motorcycle may be equipped with a Tour-Pak with wraparound backrest or a compact backrest, depending on the configuration previously agreed for the Ride.

For operational and safety reasons, the assigned configuration cannot be changed during the Ride.

7.4. Luggage and personal items

Only small personal items that can be safely stored in the available motorcycle storage space may be carried.

If the passenger wishes to bring a backpack, bag or other luggage, this must be communicated in advance so that Ride Experience Barcelona can check whether it can be transported safely.

Suitcases and bulky items that cannot be safely stored may not be carried.

Mobile phones, cameras, selfie sticks or other objects that could fall, distract the passenger or pose a risk may not be held in the hand while the motorcycle is moving.

Drinks must remain closed and securely stored while the motorcycle is moving.

7.5. Personal belongings

The passenger is responsible for their personal belongings during the experience and must ensure that they are properly stored before starting or resuming the Ride.

Ride Experience Barcelona will provide reasonable assistance in the event of loss or an incident, without prejudice to any liability that may legally apply where an item has expressly been placed in its custody.

8. Experience and safety rules

The safety of the passenger, rider and third parties will take priority throughout the Ride.

8.1. Pre-Ride briefing

Before starting the experience, the passenger will receive a mandatory safety briefing covering, among other matters:

  • how to get on and off the motorcycle;
  • correct riding position;
  • how to hold on;
  • behaviour when cornering and during motorcycle movements;
  • basic signals for communicating with the rider;
  • rules applicable during stops.

The passenger must pay attention to and follow the instructions provided.

8.2. Riding

The motorcycle will be operated exclusively by the assigned rider.

Ride Experience Barcelona does not offer a speed or performance-riding experience.

The rider will at all times adapt their riding to traffic, road conditions, weather and the passenger, comply with road traffic regulations and prioritise safety.

8.3. Communication while riding

Before departure, simple signals will be agreed so that the passenger can tell the rider that they need to stop or that an issue has arisen.

When a stop is required, the rider will stop at the next location where it is safe and permitted to do so.

8.4. Passenger behaviour

While the motorcycle is moving, the passenger must:

  • remain properly seated;
  • keep their feet on the footrests;
  • follow the rider’s instructions;
  • avoid movements or behaviour that could affect the stability of the motorcycle;
  • keep safely stored any items that cannot be used safely.

No conduct that could compromise the safety of the passenger, rider or third parties will be permitted.

Serious or repeated failure to follow safety instructions may result in the experience being terminated without entitlement to a refund.

8.5. Stops during the Ride

Rides may include stops to rest, enjoy the surroundings or take photographs.

Their location and duration may be adapted when traffic, parking, safety or other circumstances make this advisable.

If the passenger requires an additional stop, they must inform the rider, who will stop at the next suitable location where possible.

8.6. Illness or discomfort during the experience

If the passenger feels unwell during the Ride, they must inform the rider as soon as possible. A safe stop will be made to assess the situation and determine whether it is possible to continue.

Where there are reasonable grounds to consider that continuing could compromise safety, the rider may terminate the experience.

Where a serious, unforeseeable illness or condition not attributable to conduct incompatible with these Terms and Conditions makes it necessary to terminate the Ride, Ride Experience Barcelona will apply the proportional refund table established in Section 14.4, and the full-refund exception applicable to interruptions attributable to Ride Experience Barcelona will not apply.

This policy will not apply where the interruption results from alcohol or other substance use, failure to follow safety instructions, deliberately false or omitted relevant information, or any other conduct attributable to the passenger. In such cases, no refund may be due.

Where necessary to assess the application of this policy, Ride Experience Barcelona may request reasonable and proportionate evidence of the circumstances without requiring unnecessary medical information.

8.7. Final decision on safety matters

The passenger’s preferences will be taken into account whenever possible, but the final decision on any matter affecting riding or safety rests with the rider.

9. Rides, customisation and modifications

Rides will be carried out with reference to the route, duration and characteristics described on the website or expressly agreed with the customer.

9.1. Planned route

Published itineraries represent the intended route for each experience.

Reasonable variations may occur as a result of traffic, roadworks, traffic restrictions, events, weather conditions, instructions from authorities, safety considerations or other circumstances affecting the originally planned route.

Whenever possible, Ride Experience Barcelona will seek to preserve the essence, approximate duration and main points of interest of the booked experience.

9.2. Customisation before the Ride

The customer may request modifications or customisations when making the booking.

Where these involve significant changes to the route, duration or distance, they should preferably be requested at least 24 hours in advance.

Ride Experience Barcelona will assess their feasibility and communicate any resulting changes to the price or characteristics of the Ride before accepting them.

A customisation will only be considered part of the booking once it has been expressly accepted by Ride Experience Barcelona.

9.3. Spontaneous changes during the Ride

Minor changes requested by the passenger during the experience may be considered where they are simple, safe and compatible with the available time.

Where adding a new stop or modification would require a significant proportion of the available time, another planned stop may need to be replaced.

9.4. Stops and specific locations

Planned stopping locations, including those intended for photographs, may be changed if the rider considers that current conditions do not allow the motorcycle to stop safely or legally.

The passenger may suggest an additional stop, but the final decision as to where the motorcycle may stop will always rest with the rider.

9.5. Experiences with free time at the destination

Where a Ride includes free time at a destination —as may occur on certain Rides outside Barcelona— the customer may use that time independently.

Unless expressly stated otherwise, the rider does not provide tourist guide services during this period.

The passenger must return to the agreed meeting point at the specified time in order to continue the Ride as planned.

Any services, food and drink, purchases, admission tickets or activities arranged by the customer during this period are entirely at their own discretion and, unless expressly stated otherwise, are not included in the price of the Ride.

9.6. Experiences involving several motorcycles

Where several motorcycles participate, all will follow the same planned route, although traffic conditions may prevent them from riding together at all times.

Riders will not carry out unsafe manoeuvres, acceleration or waiting in order to keep the group together.

If temporary separation is necessary, the planned reference points or meeting points will be used to regroup safely.

10. Changes requested by the customer

Ride Experience Barcelona will seek to accommodate changes of date or time when the customer’s circumstances change, subject to availability.

10.1. First change of date or time

The customer may request one change of date or time at no additional cost, provided that the request is made at least 24 hours before the scheduled start of the Ride.

The new date or time will be subject to availability.

If the requested alternative is unavailable, the original booking will remain in effect unless both parties agree on another solution.

10.2. Changes with less than 24 hours’ notice

Requests received less than 24 hours in advance will be assessed individually and cannot be guaranteed.

If the requested change cannot be accommodated and the customer decides not to take the originally booked Ride, the applicable cancellation conditions will apply.

10.3. Second and subsequent changes

From the second date or time change requested by the customer onwards, each additional change will incur a €20 administration fee, provided that the requested change is possible and has been accepted in advance by Ride Experience Barcelona.

Ride Experience Barcelona will first check availability for the requested new date or time. If available, the customer will receive a link to pay the corresponding fee.

The change will only become effective and the new date or time will only be confirmed once this payment has been completed.

If the requested change cannot be accepted due to lack of availability, no fee will be charged and the existing booking will remain in effect.

Changes resulting from a modification, cancellation or inability to provide the service attributable to Ride Experience Barcelona will not count as customer-requested changes and will not be subject to this administration fee.

11. Cancellations and refunds

The customer may cancel their booking by notifying Ride Experience Barcelona through the available contact channels.

As a general rule, the following conditions will apply:

  • More than 48 hours before the start of the Ride: refund of the amount paid, from which up to 10% may be deducted for administration expenses and costs actually incurred as a result of the booking and its cancellation.
  • Between 24 and 48 hours before the start, inclusive: refund of 70% of the amount paid.
  • Less than 24 hours before the start: no refund.
  • No-show: no refund.

Deadlines will be calculated by reference to the scheduled date and start time of the Ride.

11.1. Exceptional circumstances

Where cancellation results from a serious, unforeseeable circumstance beyond the customer’s control, such as illness or an accident that reasonably prevents them from participating, Ride Experience Barcelona will assess the situation individually and, whenever possible, prioritise rescheduling the experience.

Where justified circumstances make rescheduling impracticable, a full or partial refund may be agreed without applying the administration expenses applicable to a voluntary cancellation.

Ride Experience Barcelona may request reasonable information demonstrating the circumstances claimed, while respecting the principle of personal data minimisation.

11.2. Passenger substitution

Where the customer cannot participate, they may request that another person take their place, provided that Ride Experience Barcelona gives prior approval and the new passenger meets all participation and safety requirements.

The substitution will not be considered confirmed until it has been expressly accepted.

11.3. Processing refunds

Where a refund is due, Ride Experience Barcelona will process it, wherever possible, using the same payment method used for the booking.

Once the refund has been issued, the time required for the amount to become available may depend on the financial institution or payment provider used.

12. Weather and adverse conditions

The experiences take place outdoors and on a motorcycle, so weather conditions may affect their operation.

An unfavourable weather forecast does not automatically result in cancellation of the Ride.

Ride Experience Barcelona will monitor conditions and make its decision based on the actual and expected conditions along the route.

12.1. Light rain or conditions compatible with safety

Where conditions allow the experience to be carried out safely, the Ride may:

  • proceed as planned;
  • be reasonably delayed;
  • or be adapted in terms of route, stops or operation.

If Ride Experience Barcelona considers that the experience can be carried out safely but the customer voluntarily decides not to participate, a possible rescheduling will be considered where feasible, but there will be no automatic entitlement to a refund.

12.2. Weather conditions incompatible with safety

Where Ride Experience Barcelona considers that weather conditions do not allow the Ride to be carried out safely, it may delay departure, modify the route, propose a new date or cancel the experience.

Whenever reasonable for both parties, rescheduling the Ride will be prioritised.

If Ride Experience Barcelona ultimately decides that the experience cannot be carried out safely and no new date can be agreed, the customer will receive a full refund of the amount paid.

No cancellation or administration fees will apply in this case.

12.3. Changes in conditions during the Ride

If weather conditions deteriorate after the experience has started, the rider may modify the route, stop, wait for conditions to improve or terminate the Ride early when continuing would not be safe.

Where the experience has to be permanently terminated due to unforeseen weather conditions that Ride Experience Barcelona considers incompatible with safety, and the cause is not attributable to the customer, the following refund policy will generally apply, based on the approximate duration of the experience actually completed:

  • Less than 25% of the Ride completed: 100% refund.
  • Between 25% and less than 50% completed: 75% refund.
  • Between 50% and less than 75% completed: 50% refund.
  • 75% or more completed, but the experience could not be completed: 25% refund.

These refunds will not be subject to the administration expenses applicable to voluntary cancellations by the customer.

Where conditions allow the Ride to resume safely, continuation will be prioritised. Where this is not possible and the customer agrees, Ride Experience Barcelona may offer rescheduling or an alternative solution instead of the corresponding refund.

13. Delays and no-shows

The customer must arrive at the specified meeting point 15 minutes before the scheduled departure time in order to complete the briefing and necessary preparations.

The booked time is the scheduled start time of the Ride.

13.1. Customer delay

If the customer expects to arrive late, they must notify Ride Experience Barcelona as soon as possible.

The safety briefing cannot be omitted or shortened in a way that compromises its purpose.

Depending on the length of the delay and operational circumstances, the Ride may proceed, be adapted or have certain stops reduced in order to respect subsequent commitments.

A delay by the customer does not automatically entitle them to an extension of the scheduled duration of the experience.

13.2. No-show

If 20 minutes have elapsed from the scheduled departure time and the customer has neither arrived nor communicated with Ride Experience Barcelona or reached a prior agreement, the booking may be considered a no-show.

In this case, no refund will be due.

If the customer has notified Ride Experience Barcelona of the delay in advance, Ride Experience Barcelona will try to find a reasonable solution —waiting, adapting the Ride or considering rescheduling— where availability and operational arrangements permit.

13.3. Delay during free time at the destination

Where the Ride includes a period of free time, the passenger must return to the meeting point at the agreed time.

If the passenger does not arrive, Ride Experience Barcelona will attempt to contact them and will wait for a reasonable period.

If 20 minutes have elapsed from the agreed meeting time and the passenger has not arrived and no alternative solution has been agreed, the rider may begin the return journey without them where necessary for operational reasons.

In such circumstances, the passenger will be responsible for arranging and paying for their own return transport.

This rule will not be applied automatically where there are indications that the delay may be due to an emergency or situation requiring assistance.

14. Changes, interruptions or cancellations by Ride Experience Barcelona

Ride Experience Barcelona may modify, delay, interrupt or cancel an experience where there are safety reasons, significant operational circumstances, breakdowns, traffic restrictions, instructions from authorities, adverse weather conditions or other circumstances preventing the service from being provided under appropriate conditions.

14.1. Changes that do not substantially alter the experience

Reasonable changes to the route, direction of travel, stops or operation resulting from traffic, roadworks, events, restrictions or similar circumstances will not in themselves entitle the customer to a refund, provided that the nature and duration of the booked experience are substantially maintained.

Ride Experience Barcelona will seek to provide an equivalent alternative wherever possible.

14.2. Delay attributable to Ride Experience Barcelona

If Ride Experience Barcelona is delayed in relation to the agreed time, it will seek to maintain the full duration of the Ride by moving its schedule where the customer is able to accept this.

Where the delay is significant and the customer cannot take the experience at the proposed new time, the customer will be offered the option of rescheduling or receiving a full refund of the amount paid.

14.3. Inability to start the Ride

Where Ride Experience Barcelona determines before departure that the Ride cannot take place for a reason not attributable to the customer, a new date or time will be proposed whenever possible.

If no agreement can be reached to reschedule the Ride, the customer will be entitled to a full refund of the amount paid.

14.4. Interruption after the Ride has started

Where circumstances not attributable to the customer require the experience to be terminated early and it is not possible to continue or provide a reasonable alternative solution, the following refund policy will generally apply, based on the approximate duration of the experience actually completed:

  • Less than 25% completed: 100% refund.
  • Between 25% and less than 50% completed: 75% refund.
  • Between 50% and less than 75% completed: 50% refund.
  • 75% or more completed without being able to finish the experience: 25% refund.

The administration expenses applicable to voluntary customer cancellations will not be deducted from these refunds.

Exclusively where the reason requiring the Ride to be interrupted is attributable to Ride Experience Barcelona and, taking into account the nature of the experience and the specific circumstances, the essential purpose of the Ride has been substantially frustrated, the customer will be entitled to a full refund of the amount paid, without prejudice to any other rights they may have under applicable law.

This exception will not apply where the interruption results from circumstances not attributable to Ride Experience Barcelona, including circumstances related to the passenger or external circumstances.

14.5. External circumstances not attributable to either party

Where the experience has to be interrupted due to an external circumstance attributable neither to the customer nor to Ride Experience Barcelona —such as an unexpected road closure, restrictions imposed by authorities, serious road accidents, fires or similar circumstances— priority will be given to adapting the route or providing a reasonable alternative that allows the experience to continue.

If this is not possible and the Ride must end early, the proportional refund table in Section 14.4 will generally apply, without application of the full-refund exception established for interruptions attributable to Ride Experience Barcelona.

Where the circumstances prevent access to an element constituting an essential part of the Ride, Ride Experience Barcelona will prioritise rescheduling or an equivalent alternative before terminating the experience.

15. Breakdowns, incidents and emergencies

Ride Experience Barcelona maintains its motorcycles and carries out the necessary checks to reduce the risk of incidents during the service. Nevertheless, as with any vehicle, a breakdown or unforeseen circumstance may occur during the experience.

In the event of any incident, the safety and care of those involved will take priority over continuation of the Ride.

15.1. Breakdown before the Ride starts

If a breakdown or technical issue prevents the assigned motorcycle from being used before the experience begins, Ride Experience Barcelona will, where possible, seek an alternative solution that allows the Ride to take place.

If the service cannot be provided under appropriate conditions, the customer will be offered the option of rescheduling the experience or receiving a full refund of the amount paid.

15.2. Breakdown during the Ride

If a breakdown, warning or fault arises during the Ride that could affect the safety or proper functioning of the motorcycle, the rider will stop as soon as it is safe to do so and assess the situation.

The Ride will only continue when the rider considers that it is completely safe to do so.

If the issue prevents the Ride from continuing, Ride Experience Barcelona will arrange the necessary assistance and seek a reasonable solution for the passenger.

Where it is not possible to continue or provide an appropriate alternative solution, the refund policy established in Section 14.4 will apply, taking into account the part of the experience actually completed and, where applicable, whether the essential purpose of the Ride has been substantially frustrated.

15.3. Accident or incident during the experience

In the event of an accident or incident that may affect the physical safety of any participant, priority will be given to protecting those affected and preventing further risks.

Where circumstances require, the emergency services or competent authorities will be contacted and their instructions followed.

Continuation of the Ride will depend on whether it can be carried out safely.

15.4. Passenger illness or emergency

If the passenger becomes unwell or experiences an emergency during the Ride, they should inform the rider whenever they are able to do so.

The rider will find a safe place to stop and, where the situation requires, request assistance from the emergency services.

Ride Experience Barcelona may use the emergency contact details provided by the passenger where justified by the circumstances, in accordance with the Privacy Policy.

15.5. Rider illness or incapacity

If the rider is not in a condition to continue riding safely, the Ride will be interrupted.

Ride Experience Barcelona will arrange the necessary assistance or solution for the passenger and, where it is not possible to continue the experience or provide an appropriate alternative solution, the refund policy set out in Section 14.4 will apply.

15.6. External circumstances and actions by authorities

The Ride may be modified, interrupted or terminated where required by the authorities or where external circumstances —such as road accidents, road closures, fires, emergencies or similar situations— make it unsafe or impossible to continue as planned.

Under no circumstances will the rider enter closed, restricted or unsafe areas in order to maintain the original route.

Where such circumstances substantially affect the provision of the service, Ride Experience Barcelona will seek to provide a reasonable alternative in accordance with these Terms and Conditions.

16. Photographs, music and other complementary elements

Certain elements included in the Ride are intended to enhance the experience but do not in themselves constitute the main purpose of the contracted service.

16.1. Photographs during the Ride

The rider may take several photographs during planned stops, provided that conditions and safety allow.

The photographs are a complementary souvenir of the experience and do not constitute a professional photography service. Accordingly, no specific number of images or particular photographic result is guaranteed.

Selected photographs will subsequently be provided to the customer through the channel or link specified by Ride Experience Barcelona.

Basic selection or correction adjustments may be made where necessary, but the service does not include personalised retouching or delivery of RAW files.

Passengers may state that they do not wish to be photographed.

16.2. Promotional use of images

Taking and providing photographs to the customer does not authorise Ride Experience Barcelona to use them for advertising, commercial or promotional purposes.

Where Ride Experience Barcelona wishes to use an identifiable image of a passenger for these purposes, specific, voluntary and separate consent will be requested in advance.

Refusal to provide such consent will not affect the ability to book or enjoy the Ride.

In the case of minors, the applicable specific authorisation requirements will also apply.

16.3. Music

Where the Ride includes music, the passenger may choose from the playlists offered by Ride Experience Barcelona.

The rider may adjust, reduce or stop the audio where necessary for safety, communication or riding purposes.

Availability of music may depend on the operation of the audio system, device, connection or service being used.

An isolated issue preventing the selected playlist from being played will not in itself entitle the customer to a refund, as music is a complementary element of the experience.

16.4. Digital guides and recommendations

Digital guides and recommendations of places, establishments or activities provided to the customer are informational and complementary in nature.

Unless expressly stated otherwise, they do not form part of a tourist guide service and do not mean that Ride Experience Barcelona provides, manages or guarantees the services offered by those third parties.

17. Liability and inherent risks

17.1. Nature of the experience

The customer acknowledges that the contracted service consists of travelling as a passenger on a motorcycle, an activity which by its nature involves inherent risks associated with road travel that cannot be completely eliminated even when appropriate safety measures are adopted.

Before starting the Ride, the passenger will receive basic information and instructions intended to ensure that the experience is carried out safely.

17.2. Passenger obligations

The passenger agrees to:

  • provide truthful information where necessary to verify participation requirements;
  • comply with the requirements established in these Terms and Conditions;
  • attend to the pre-Ride briefing;
  • follow the rider’s safety instructions;
  • behave in a manner compatible with safe riding;
  • refrain from any action that could put the rider, themselves or third parties at risk.

17.3. Ride Experience Barcelona’s obligations

Ride Experience Barcelona undertakes to provide the service with the level of care and safety reasonably required, using motorcycles suitable for the activity and riders legally authorised to operate them.

Riding and all decisions relating to safety will be the responsibility of the rider.

17.4. Acknowledgement of risks

By booking and participating in the Ride, the passenger acknowledges the nature of the activity and accepts the inherent risks reasonably associated with travelling as a passenger on a motorcycle, within the limits established by applicable law.

This acknowledgement does not constitute a waiver of any rights legally available to the consumer, nor does it exclude or limit any liability that may legally be attributable to Ride Experience Barcelona.

17.5. Failure to follow safety instructions

Ride Experience Barcelona will not be liable for consequences resulting exclusively from conduct by the passenger contrary to safety instructions, false or omitted information relevant to safe participation, or deliberate conduct incompatible with the conditions of the experience, to the extent permitted by applicable law and taking into account the specific circumstances of the case.

17.6. Personal belongings

Ride Experience Barcelona will not generally be responsible for the loss, forgetting or deterioration of belongings that remain under the passenger’s responsibility, without prejudice to any liability that may legally apply where an item has expressly been placed in Ride Experience Barcelona’s custody.

18. Third-party services and establishments

During certain Rides, Ride Experience Barcelona may provide customers with information or recommendations regarding restaurants, shops, activities, places of interest or other services provided by third parties.

Unless expressly stated otherwise, these recommendations are provided for information purposes only and do not mean that Ride Experience Barcelona acts as the provider, intermediary or party responsible for those services.

Where the customer chooses to contract, purchase or use a third-party service, the contractual relationship will be established directly between the customer and that third party and will be subject to that provider’s own terms and conditions.

Prices, opening hours, availability, quality, access conditions and other characteristics of these services are the responsibility of their respective providers and may change without Ride Experience Barcelona’s involvement.

18.1. Expenses during free time

Where a Ride includes free time at a destination, any food, drink, admission ticket, purchase, activity or service contracted directly by the customer will be at their own expense unless expressly stated as included in the experience.

18.2. Alcohol consumption

The passenger may not consume alcohol during a period of free time if they are subsequently required to travel again on the motorcycle.

If, when the Ride is due to resume, the rider reasonably considers that the passenger is under the influence of alcohol or any other substance incompatible with safety, motorcycle transport will not continue.

In such circumstances, the passenger will be responsible for arranging and paying for their own return transport and no refund will be due for the part of the service not completed for this reason.

19. Right of withdrawal

Rides offered by Ride Experience Barcelona are booked for a specific date and time.

In accordance with Article 103(l) of Royal Legislative Decree 1/2007 of 16 November (Spanish General Law for the Protection of Consumers and Users), the right of withdrawal does not apply to contracts relating to leisure activities where the contract provides for a specific date or period of performance.

Accordingly, once a booking has been formalised for a specific date and time, the customer does not have the general 14-day right of withdrawal applicable to certain distance contracts.

This does not prevent the customer from requesting a change or cancelling their booking in accordance with the change, cancellation and refund policy established in these Terms and Conditions, nor does it affect any other rights available to them under applicable law.

20. Personal data protection

Personal data provided by the customer will be processed in accordance with applicable data protection legislation and the Ride Experience Barcelona Privacy Policy available on the website.

Depending on the circumstances, personal data may be used to:

  • respond to enquiries;
  • manage booking requests and bookings;
  • provide and coordinate the contracted service;
  • carry out necessary operational communications;
  • manage payments, invoicing and administrative obligations;
  • manage incidents relating to the experience;
  • comply with legal obligations;
  • and, where applicable, manage emergency contacts or authorisations relating to minors.

Ride Experience Barcelona will only request data that is necessary and proportionate for each purpose.

20.1. Operational communications

The customer accepts that communications necessary to manage their booking and provide the service may be carried out through the channels provided, including WhatsApp where it has been used or designated as an operational channel.

These communications may include information concerning the booking, payment, meeting point, schedules, weather, changes, instructions, incidents, photographs or guides relating to the Ride.

Use of these data to manage the service does not constitute consent to receive regular commercial communications.

20.2. Functional information and health data

Ride Experience Barcelona will not generally request medical records, diagnoses or other detailed health information.

To confirm that the passenger can participate safely, only the necessary functional confirmations under these Terms and Conditions will preferably be requested.

If, exceptionally, it becomes essential to process health-related information, such processing will be limited to the minimum necessary and carried out only where a lawful basis exists under applicable data protection legislation.

20.3. Data relating to other passengers

Where one person makes a booking for other passengers, Ride Experience Barcelona may request the minimum data necessary to manage their participation. The person providing such data must ensure that they are entitled to provide them and that the data are accurate and relevant for the purpose of the booking.

Where necessary, Ride Experience Barcelona will provide the other passengers with the relevant information concerning the processing of their personal data.

20.4. Full information

Full information concerning the identity of the data controller, legal bases for processing, recipients, retention periods or criteria, exercise of rights and other required information is provided in the Privacy Policy.

21. Applicable law, complaints and dispute resolution

These Terms and Conditions will be governed by and interpreted in accordance with Spanish law and, where applicable, consumer protection legislation applicable in Catalonia.

If the customer considers that an issue has arisen in connection with the booking or provision of the service, they may submit a complaint to Ride Experience Barcelona at:

Ride Experience Barcelona will respond to complaints as soon as possible and, in all cases, within the maximum statutory period of one month from receipt.

Ride Experience Barcelona makes official complaint forms available to consumers and users in accordance with the regulations applicable in Catalonia.

21.1. Dispute resolution

Where a complaint submitted directly to Ride Experience Barcelona has not been resolved satisfactorily, the customer will be provided with the relevant information regarding the competent alternative consumer dispute resolution bodies, in accordance with applicable regulations, including whether Ride Experience Barcelona will participate in the relevant procedure.

Consumer mediation and arbitration may be used where appropriate and where the applicable requirements are met.

21.2. Competent jurisdiction

Any dispute arising from the booking or provision of the service will be subject to the courts and tribunals having jurisdiction under applicable law.

Where the law allows the parties to determine territorial jurisdiction, the parties agree to submit to the Courts of Barcelona.

In relations with consumers and users, this provision is without prejudice to the jurisdiction legally available to them and any other right of choice recognised by applicable law.

22. Amendments and validity of these Terms and Conditions

These Terms and Conditions enter into force on the date stated at the beginning of this document and will remain in force until replaced by a new version.

Ride Experience Barcelona may amend these Terms and Conditions where necessary as a result of changes to the service, operational criteria, payment methods, applicable legislation or other justified circumstances.

Changes will not retroactively alter the conditions applicable to a booking that has already been confirmed, except where required by law or where the change is expressly agreed with the customer.

Each booking will be governed by the Terms and Conditions that were in force and made available to the customer at the time the booking was made.

Ride Experience Barcelona will maintain an internal system allowing the version and date of the Terms and Conditions applicable to each booking to be identified.
